United States Ninth Circuit
Pulaski & Middleman v. Google, Inc., 12-16752
In a class action filed by online advertisers against Google alleging violations of California's Unfair Competition Law and Fair Advertising Law, the district court's denial of class certification is reversed where questions regarding which advertisers are entitled to restitution and in what amount did not defeat the predominance requirement under Rule 23(b)(3), as held in Yokoyama v. Midland Nat'l Life Ins. Co., 594 F.3d 1087 (9th Cir. 2010).
