US v. Rivera-Constantino, 14-10314

Sentence for illegal reentry is affirmed where a prior federal conviction for conspiring to possess marijuana with intent to distribute, 21 U.S.C. section 846 and 841(a)(1), constitutes a prior conviction for conspiring to commit a drug trafficking offense as that phrase is used in the commentary to U.S.S.G. section 2L1.2(b)(1), thereby making defendant subject to a 16-level enhancement under section 2L1.2(a)(1)(A).
