Petition for review of the Board of Immigration Appeals' affirmance of an IJ's denial of petitioner's motion for a continuance, is denied where: 1) the statutory criminal bar, 8 U.S.C. section 1252(a)(2)(C), does not strip this court of jurisdiction to review the denial of a procedural motion that rests on a ground independent of the conviction that triggered the bar; and 2) the IJ did not abuse discretion in denying the motion to continue.
