First Intercontinental Bank v. Ahn, 13-56097
In a diversity breach of contract action involving a bank loan, the district court's award of attorney fees to the borrower-defendant is affirmed where: 1) California's choice of law rules govern whether Georgia or California law applied to the attorney's fee issue, because the diversity action was brought in California; and 2) the district court correctly concluded that California law, including California Civil Code section 1717(a), governed the outcome of the case, and awarded attorney's fees to defendant.
