Hamdan v. US Dep't of Justice, 13-55172
In a suit under the Freedom of Information Act (FOIA) arising from plaintiffs request of information from a myriad of federal agencies about federal investigations related to Naji Mandan and any US role in his detention and torture by United Arab Emirates, the district court's summary judgment in favor several agencies is: 1) affirmed in part as to the court's rulings of the adequacy of the agencies' search and the application of FOIA exemptions, specifically the holding that the Defense Intelligence Agency properly withheld records under Exemption 3 because those records were protected under 10 U.S.C. section 424; and 2) vacated and remanded in part where the court erred by not making findings on the issue of segregability.
