US v. Temkin, 12-50103

Convictions for solicitation to commit a crime of violence, attempted extortion violation of the Hobbs Act, and use of interstate commerce facilities in the commission of murder-for-hire are affirmed where the evidence supported the convictions, but the sentence is vacated where in applying the Sentencing Guidelines to the conviction under 18 U.S.C. section 1958 for use of interstate commerce facilities in the commission of murder-for-hire, the district court erred by using the base offense level of 32 set forth in U.S.S.G. section 2E1.4(a)(1) rather than the cross-referencing provision in U.S.S.G. section 2E1.4(a)(2).
