United States Ninth Circuit
T.B. v. San Diego Unified School Dist., 12-56060
In an action brought by a disabled student and his parents against a school district under the Americans with Disabilities Act and Section 504 of the Rehabilitation Act, the district court's judgment is: 1) affirmed as to grant of summary judgment in favor of the school on a claim that the district retaliated against the student and his mother in violation of the ADA; and 2) reversed in part with regard to the determination of attorney's fees and costs under Individuals with Disabilities Education Act (IDEA) where the court abused its discretion in concluding that the fee claim was unreasonable.
