US v. Mark, 13-10579

In an action brought by a plaintiff who was promised immunity by the FBI in return for his cooperation with a mortgage-fraud scheme investigation, the district court's denial of defendant's motion to reconsider its denial of his motion to dismiss the indictment is reversed where in light of the scant record supporting the government's claim that defendant breached the immunity agreement, and clear evidence that key details of the government's story were inaccurate, the district court abuse its discretion when it failed to either grant the motion or order an evidentiary hearing.
