In an antitrust suit brought against ICANN, a corporation which, under contract with the Department of Commerce creates and assigns top level domains, such as ".com" and ".net," the district court's dismissal is affirmed where: 1) the complaint did not state a claim for conspiracy in restraint of trade or commerce under Section 1 of the Sherman Act because it did not sufficiently allege an anticompetitive agreement; and 2) the trademark and unfair competition claims were not ripe for adjudication because the complaint did not allege that ICANN has delegated or intends to delegate any of the top level domains that plaintiff uses.
