United States Ninth Circuit
Organized Village of Kake v. US Dep't of Agric., 11-35517
In an action challenging the Department of Agriculture's dramatically changed findings on the application of the "Roadless Rule," which limits road construction and timber harvesting in national forests, on the Tongass National Forest, the district court's grant of summary judgment in favor of plaintiffs is affirmed where the Administrative Procedure Act requires a reasoned explanation for this change in course.
