Multi Time Machine, Inc. v. Amazon.com, Inc., 13-55575

In a trademark infringement action brought under the Lanham Act against an online retailer, alleging that defendant's website infringed plaintiff's trademark because of the manner in which the website responded to a shopper's search request for the watches, the district court's grant of summary judgment to defendant is reversed where a jury could find that defendant had created a likelihood of confusion under an "initial interest confusion" theory by responding to a search request with a page showing "MTM Special Ops" three times above a search results displaying similar watches manufactured by plaintiff's competitor.
