United States Ninth Circuit
CHMM, LLC v. Freeman Marine Equipment, Inc., 13-35163
In an admiralty case in which a vessel owner sued for the physical damage a defective vessel component caused to property that the owner added to the vessel before the vessel was delivered, the district court’s interlocutory order dismissing the five tort claims as barred by the economic loss doctrine, is reversed where the vessel owner’s tort claims were not barred by the economic loss doctrine.
