Pavonni v. Chrysler Group LLC, 13-55761
In a diversity action against Chrysler alleging strict products liability and other theories for liability for deaths that occurred in a 2008 Chrysler Grand Caravan automobile, the district court's grant of summary judgment to defendant is reversed and awarded costs are vacated where: 1) genuine issues of material fact existed as to whether a "false park" defect in the Grand Caravan caused the deaths of the plaintiffs' mother and her husband; and 2) the district court incorrectly applied the relevant California substantive law.
