Conviction for aggravated identity theft, 18 U.S.C. section 1029A, is affirmed where, even though defendant has permission to use his twin brother's passport, and purportedly did not use the passport "without lawful authority," as required by the statute, section 1028A does not require theft as an element of the offense, and the illegal use of the means of identification alone violates the statute.
