Stankova v. Metropolitan Property and Casulty Ins. Co., 12-17575
In a case arising out of a wildfire that swept through Northern Arizona that created an environment in which flooding and mudslides destroyed plaintiff's house, the district court's grant of summary judgment to insurer is reversed where, under New York law, there was a triable issue as to whether the damage at issue could have been directly and proximately caused by the wildfire.
