United States Ninth Circuit

US v. Hornbuckle, 12-10541

Sentences for sex-trafficking of children in violation of 18 U.S.C. section 1591 are affirmed where: 1) the application of an enhancement under U.S.S.G. section 2G1.3(b)(4)(A) was not double counting because "commission of a sex act or sexual contact" is not an element of a conviction under section 1591; and 2) the district court properly applied an enhancement under U.S.S.G. section 2G1.3(b)(2)(B) for undue influence.
