C.W. v. Capistrano Unified School District, 12-57315
In this case, the district court awarded attorney's fees and costs to defendant School District as the prevailing defendant in an action in which plaintiffs alleged violations of the Individuals with Disabilities Education Act (IDEA), Americans with Disabilities Act (ADA), section 504 of the Rehabilitation Act, and 42 U.S.C. section 1983. The judgment of the district court is: 1) affirmed to the extent that it awarded attorney's fees and costs for representation relating to the ADA and section 1983 claims, where those claims were frivolous, lacked any legal foundation, and the result was obvious; and 2) reversed to the extent it awarded attorney's fees and costs related to the litigation of the IDEA and Rehabilitation Act claims, where those claims were not frivolous, nor were they brought for an improper purpose.
