Kohler v. Bed Bath & Beyond of California, 12-56727

In this case, plaintiff-paraplegic brought suit against defendant for alleged violations of the Americans with Disabilities Act (ADA), U.S.C. sections 12101-12213, and related state law provisions on grounds that floor and wall space barriers in the restroom of defendant's store impeded plaintiff's ability to fully use the store. Summary judgment in favor of defendant on plaintiff's ADA Title III claims is affirmed, where: 1) the ADA does not require wall space within the maneuvering clearance next to the frame of a restroom door that must be pulled open; and 2) because the door lacked a "latch" within the meaning of standards governing ADA compliance, no maneuvering space was required next to the frame of a restroom door that must be pushed open.
