In this case, plaintiff challenged the decision of defendants to permit recurring, low altitude helicopter flights to haze bison in the Yellowstone Grizzly Bear Recovery Zone. Judgment in favor of defendants is: 1) reversed as to the district court' holding that plaintiff lacked standing to bring its Endangered Species Act (ESA) and National Environmental Policy Act claims, and reversed as to the ruling that plaintiff failed to comply with the ESA citizen suit 60-day notice provision; and 2) affirmed in all other respects.
