US v. Waters, 13-50332
Dismissal of defendant's motion for reduction of sentence brought under 18 U.S.C. section 3582(c)(2) is affirmed, where: 1) Sentencing Guidelines Amendment 759 had no effect on defendant's applicable guideline range due to his career offender status; and 2) because application of a 2011 amendment to Application Note 6 of U.S.S.G. section 1B1.10 would not increase the punishment for the crime over what was imposed when the defendant was sentenced, there is no ex post facto problem.
