Lai v. Holder, 10-73473

In this case, the court’s previously filed opinion granted a petition or review of the Board of Immigration Appeals’ denial fo asylum, withholding of removal, and protection under the Convention of Torture on grounds that substantial evidence did not support the adverse credibility determination of the Immigration Judge (IJ), and that under Ren v. Holder and Zhi v. Holder, the IJ erred in failing to give petitioner notice and opportunity to present corroborating evidence. The government then moved to delete the discussion of Zhi and Ren. The government’s motion is denied, and the opinion amended to explain that Ren’s notice requirements apply, where, as here, the IJ found the petitioner not credible, and relied on the lack of corroboration as part of that credibility determination.
