In this litigation involving union membership, the district court dismissed plaintiff Carpenters union and its subordinate organizations and members' complaint alleging that defendants violated the federal duty of fair representation by convincing the Metal Trades union to wage a campaign against members of the Carpenters union that included stripping them of their positions as union stewards solely because they were members of the Carpenters. Dismissal is affirmed, where the duty of fair representation does not forbid consideration of union affiliation in the appointment and removal of stewards, as it is not unreasonable discrimination to select stewards from whom the union might expect undivided loyalty.
