US v. Moore, 13-10464
Denial of motion to suppress evidence obtained through a search of defendant's residence is affirmed, where: 1) under Georgia v. Randolph, a resident who is refusing consent must be present at the house and expressly refuse to allow the search; and 2) the search was not a violation of the Fourth Amendment, as defendant refused to come to the door and acquiesced in letting his fiancé deal with the police.
