United States Ninth Circuit

Ollier v. Sweetwater Union High School District, 12-56348

In this class action suit brought pursuant to Title IX of the Education Amendments alleging unequal treatment, benefits, and participation opportunities in athletic programs, and retaliation, judgment granting injunctive relief to plaintiff-students is affirmed, where: 1) defendants did not fully and effectively accommodate the interests and abilities of female athletes; 2) plaintiffs had Article III standing to bring their Title IX retaliation claim arising from the firing of the softball coach; and 3) defendants' purported non-retaliatory reasons for firing the coach were pretextual excuses for unlawful retaliation.
