MEIC v. Stone-Manning, 13-35107
In this citizen suit alleging that defendant-Director would violate duties imposed by the Surface Mining Control and Reclamation Act by approving a pending application for a mining permit, dismissal for lack of subject matter jurisdiction is affirmed, where: 1) plaintiffs lacked standing; and 2) plaintiffs' claims for declaratory and injunctive relief were not ripe, as the alleged injury was not imminent, and plaintiffs' allegations did not establish a substantial risk that defendant would grant the permit application at all.
