In this citizen suit challenging, pursuant to the Clean Water Act (CWA), defendants' non-stormwater discharges of coal into an Alaskan bay, summary judgment entered in favor of defendants is reversed and remanded, where the district court erred in concluding that defendants' General Permit for Stormwater Discharges Associated with Industrial Activity shielded defendants from liability under the CWA for their non-stormwater coal discharges.
