US v. Luis, 13-50020

Restitution order is: 1) affirmed in part, where defendant committed an "offense against property" for his part in the purchase of two parcels of real property with fraudulently obtained loans, and plaintiff JP Morgan Chase (Chase) was a "victim", thus satisfying the requirements of the Mandatory Victim Restitution Act (MVRA); 2) the district court properly calculated restitution for plaintiff CitiGroup; and 2) vacated in part and remanded to recalculate restitution for Chase, where the district court applied a formula for a loan originator even though Chase had purchased the loans.
