United States Ninth Circuit
US v. Mendez, 13-30170
Denial of a motion to dismiss a second-degree unlawful possession of a firearm charge under 18 U.S.C. section 922(g)(1) is affirmed, where: 1) under Washington law, despite the fact that defendant was a juvenile when charged, second-degree unlawful possession of a firearm is "a crime punishable by imprisonment for a term exceeding one year", and may therefore serve as a predicate for section 922(g)(1) prosecution; and 2) under Washington law, juvenile adjudications are treated as convictions once a defendant enters the adult criminal justice system.
