Murphy v. Sloan, 13-17339

In this suit brought under the Hague Convention by plaintiff-mother to compel her child's return to Ireland from defendant-father's care in the US, denial of plaintiff's petition is affirmed, where: 1) the two parents never had the shared, settled intent to shift the child's habitual residence from the US to Ireland; and 2) the child's attachments to Ireland, though significant, did not shift the locus of her development, and any acclimatization did not overcome the absence of a shared, settled intent to abandon the US as habitual residence.
