Mastro v. Rigby, 13-35209

Dismissal of an appeal by a nonclaimant (appellant Mastro) to the bankruptcy estate is reversed and remanded, where: 1) the trustee for the bankruptcy estate of the nonclaimant's husband secured a bankruptcy court judgment holding nonclaimant liable for fraudulent transfers, whereupon nonclaimant fled to France; and 2) the district court abused its discretion in dismissing the appeal under the fugitive disentitlement doctrine because no necessity justified invoking the rule of disentitlement.
