United States Ninth Circuit
Martinez v. Aero Caribbean, 12-16043
Dismissal of plaintiffs' claims against defendant-airline for lack of personal jurisdiction is affirmed, where: 1) Burnham v. Superior Court does not apply to corporations, and so service of process on a corporation's officer within the forum state does not create general personal jurisdiction over the corporation; 2) a court may exercise general personal jurisdiction over a corporation only when its contacts "render it essentially at home" in the state; and 3) under the demanding jurisdictional standard of Daimler AG v. Bauman, the defendant’s contacts were insufficient to subject it to general jurisdiction in California.
