US v Cisneros, 13-30066

District court’s imposition of a mandatory minimum sentence of 180 months' imprisonment pursuant to the Armed Career Criminal Act (ACCA) 18 U.S.C. section 924(e)(1) is affirmed, where: 1) all three of defendant’s convictions for fleeing or attempting to elude police officers qualify as violent felonies under ACCA’s residual clause; 2) the ACCA's residual clause is not unconstitutionally vague; and 3) US v. Mayer applies to the defendant's first-degree burglary convictions, which means those convictions qualify as predicate offenses under ACCA.
