United States Ninth Circuit
La Quinta Worldwide v. Q.R.T.M., 12-15985
The district court's judgment in favor of plaintiff in a trademark infringement case is: 1) affirmed in part, where there is federal subject-matter jurisdiction over the trademark claims, the district court correctly concluded that expansion of defendant's Mexican hotel business into the United States would result in a likelihood of consumer confusion with plaintiff, and the defense of laches did not apply; but 2) vacated in part and remanded with regard to the permanent injunction imposed on defendant, where the district court did not provide a sufficient analysis balancing the equities in its decision.
