Rundgren v. JP Morgan Chase Bank, 12-15368

Dismissal of plaintiffs' claims against defendant-bank is affirmed, where: 1) the action arises out of the fraudulent acts by Washington Mutual Bank, which was placed into the receivership of the Federal Deposit Insurance Company (FDIC), who then transferred certain of the assets, including plaintiffs' mortgage to defendant-bank; and 2) because Washington Mutual was placed into the receivership of the FDIC and plaintiffs failed to exhaust the administrative remedies provided by the Financial Institutions Reform, Recovery, and Enforcement Act of 1989, the district court correctly determined that it lacked jurisdiction to hear plaintiffs' claims.
