United States Ninth Circuit
E.M. v. Pajaro Valley Unified School District, 12-15743
Judgment in favor of defendant-school district in an action brought by plaintiff-student, by and through his parents, under the Individuals with Disabilities Education Improvement Act of 2004, is affirmed, where: 1) plaintiffs have failed to show that defendant acted unreasonably in determining in 2005 that plaintiff-student did not qualify for special education services under the "specific learning disability" category; 2 the Department of Education's position that a central auditory processing disorder is eligible for consideration for benefits under the "other health impairment" category merits deference; but 3) plaintiffs have failed to show that defendant acted unreasonably in not considering plaintiff-student for benefits under the "other health impairment" category in 2005.
