US v. Tillman, 13-10131

The interlocutory appeal brought by defendant and appointed counsel challenging the order removing appointed counsel is dismissed, but appointed counsel's mandamus petition challenging the district court's sanctions order is granted, where: 1) the court lacks jurisdiction over defendant's claim that appointed counsel was improperly removed; 2) mandamus jurisdiction is appropriate to consider the sanctions order; and 3) the district court erred in imposing sanctions without notice and a hearing, and the order should therefore be vacated.
