In multidistrict litigation (MDL) involving the MERS System, a private electronic database that records the ownership of and servicing rights in home loans, an appeal from an order of the District Court is: 1) dismissed as to appellants' challenge to the JPML Order for lack of jurisdiction; 2) affirmed as to the MDL Court’s dismissal of the CAC, except for Count 1; and 3) reversed Count 1 and remanded as to for further proceedings.
