ReadyLink Healthcare, Inc. v. State Compensation Insurance Fund, 12-56248
In an action challenging the Commissioner of the California Department of Insurance, the District Court's dismissal on abstention grounds is affirmed, where although abstention was not proper in this case, the plaintiff's preemption claim is barred by issue preclusion under California law because while the appeal was pending, the California Court of Appeal rejection the preemption claim and the California Supreme Court denied review.
