Dismissal of plaintiff's action claiming that she was the rightful owner of two paintings forcibly purchased by the Nazis from her deceased husband's family, which now hang in defendant-museum, is reversed and remanded, where: 1) plaintiff's claims did not conflict with any federal policy because the paintings were never subject to postwar internal restitution proceedings in the Netherlands; 2) plaintiff's claims against the museum and the remedies she sought did not conflict with foreign policy, and the dispute was one between private parties; and 3) remand is necessary for further development of act of state doctrine issue.
