United States Ninth Circuit

Plata v. Brown, 13-15466

The State's petition for writ of mandamus in an ongoing prison class action concerning the provision of health care in California prisons is denied, where: 1) the district court's order to the State to disclose its expert witnesses and their reports 120 days before moving to terminate injunctive relief under consent decrees aimed at curing constitutional violations, is a sensible scheduling order designed to provide the court and plaintiffs with adequate notice of the evidence the State intended to rely upon in a motion to terminate; 2) the district court's order did not affect the operation of the Prison Litigation Reform Act's automatic stay; and 3) there was no clear error in the district court’s issuance of the order.
