United National Maintenance, Inc. v. San Diego Convention Center, Inc., 12-56809

Judgment in favor of defendant-convention center on plaintiff's claims for intentional interference with contractual relationship, antitrust violations, and intentional interference with prospective economic advantage is: 1) reversed in part and remanded the district court's grant of judgment as a matter law, which overturned the jury's verdict in favor of plaintiff-maintenance company, on its claim that defendant intentionally interfered with contracts between plaintiff and providers of trade show decorator services when defendant instituted a policy mandating that it would be the exclusive provider of cleaning services staffing; 2) affirmed in part, as to the district court's grant of judgment as a matter of law on the maintenance company's Sherman Act claim, where defendant possessed state action immunity from this antitrust claim; 3) affirmed in part, as to the dismissal of plaintiff's claim for intentional interference with prospective economic advantage because this claim turned on the antitrust claim; and 4) affirmed in part, where under California law, the convention center was excluded from liability for punitive damages.
