United States Ninth Circuit

League of Wilderness Defenders/Blue Mountains Biodiversity Project v. Connaughton, 13-35653

The district court's denial of a motion to preliminarily enjoin the Snow Basin logging project in Oregon is: 1) reversed in part and remanded for entry of a preliminary injunction, the scope of which the district court should determine on remand, where plaintiffs have shown that they are likely to prevail on their National Environmental Policy Act (NEPA) claim regarding the final Environmental Impact Statement's discussion of elk habitat; but 2) otherwise affirmed, where the district court properly determined that plaintiffs were not likely to succeed on their remaining claims.
