United States Ninth Circuit

US v. Brooks, 12-30264

The district court's order authorizing involuntary medication in order to render the defendant competent to stand trial is vacated and remanded, where: 1) the district court did not clearly err in determining that the defendant suffered from a mental illness; but 2) because over a year has passed since the district court's order was entered, a new inquiry pursuant to Sell v. United States is required.
