United States Ninth Circuit

US v. IMM, 11-10317

Defendant-juvenile's conviction for sexually abusing his six year old cousin is reversed and remanded, where: 1) the government's jurisdictional certification under 18 U.S.C. section 5032 was sufficient; 2) the district court did not err in admitting the testimony of a seven year old witness; 3) the evidence introduced at trial was sufficient to support the conviction; but 4) the district court erred when it admitted into evidence an inculpatory statement obtained from defendant in violation of his Fifth Amendment rights under Miranda v. Arizona, 384 U.S. 436 (1966).
