United States Ninth Circuit
Islamic Shura Council of Southern California v. FBI, 12-55305
The district court's order granting plaintiff's motion for Federal Rule of Civil Procedure 11(c) sanctions against defendant is reversed, where: 1) plaintiff served its motion after the district court decided the merits of the underlying dispute; and 2) the motion for fees could not serve Rule 11's purpose of judicial economy because before plaintiff filed its motion for sanctions, defendant had already corrected the challenged pleadings and provided all the additional documents it was obligated to provide under the Freedom of Information Act (FOIA) to the district court in an in camera proceeding.
