United States Ninth Circuit
Rivera v. County of Los Angeles, 11-57307
Summary judgment for defendants in an action in which plaintiff alleged multiple constitutional and state law violations arising out of his mistaken arrest and month-long detention based on a 1989 which had been issued for another person of the same name, is affirmed, where: 1) defendant did not violate the Fourth Amendment because the warrant satisfied the particularity requirement and defendants' deputies were not unreasonable in believing that plaintiff was the subject of the 1989 warrant at the time of arrest; 3) plaintiff's detention did not violate the Due Process Clause of the Fourteenth Amendment; and 4) the district court did not err in dismissing plaintiff's state law claims on the basis of state law statutory immunities.
