United States Ninth Circuit

Huang v. Holder, 09-72837

A petition for review of the Board of Immigration Appeals' (BIA) denial of an application for asylum, withholding of removal, and protection under the Convention Against Torture, is denied, where: 1) the evidence did not compel the conclusion that petitioner was credible, where the Immigration Judge's (IJ) well supported demeanor finding was entitled to special deference, and the IJ appropriately considered the record as a whole and the totality of the circumstances; and 2) the remaining evidence in the record did not compel the conclusion that petitioner met her burden of proof for relief.
