United States Ninth Circuit
Wells Fargo & Company v. ABD Insurance and Financial Services, 13-15625
The district court's denial of plaintiffs' motion for a preliminary injunction in a trademark infringement case is reversed and remanded, where the district court abused its discretion: 1) in its analysis of plaintiffs' likelihood of success on the merits of their claims; 2) when it did not consider a false advertising claim separately from a trademark infringement claim; and 3) in its analysis of the abandonment defense to the trademark infringement claim.
