United States Ninth Circuit

US v. Chandler, 12-10331

Defendant's sentence for being a felon in possession of a firearm, which included an increased penalty under the Armed Career Criminal Act (ACCA), is affirmed, where: 1) the district court correctly concluded that defendant's prior Nevada convictions for conspiracy to commit robbery and second degree kidnapping were "violent felonies" under the ACCA; and thus, 2) in addition to his prior conviction for coercion which defendant did not dispute was a violent felony, defendant had previously been convicted of three violent felonies, which subjected him to an increased penalty under the ACCA.
