Peruta v. County of San Diego, 10-56971
Summary judgment in favor of defendant-county on plaintiffs' challenge to the denial of their application for a concealed-carry permit because they could not establish "good cause" as required by defendant-county, is reversed and remanded, where: 1) the carrying of an operable handgun outside the home for the lawful purpose of self-defense constitutes bearing arms for purposes of the 2nd amendment; and 2) defendant-county's "good cause" permitting requirement impermissibly infringes on the Second Amendment right to bear arms in lawful self-defense.
